ESOS NEWSLETTER – JULY 2025 (ISSUE 38)

This issue of the ESOS Newsletter from the Environment Agency shares information on the Phase 3 Action Plan Data expected to be published at the end of July, updated Notification of Compliance Data (as of 5 June 2025), a call for senior leadership representatives (e.g. directors, senior managers) from across ESOS participating organisations to take part in DESNZ's research and more.

Publication of Phase 3 Action Plan Data

The Phase 3 Action Plan dataset, which will be published by the end of July, will contain data from action plans submitted by participants by 5 June 2025 following the submission of their Phase 3 notifications of compliance (NOCs).

The data will include:

  • the name of the organisation
  • measures that ESOS participants propose to implement by 5 December 2027 (the end of the Phase 4 compliance period)
  • dates by which the measures are proposed to be implemented (month/year)
  • the total energy savings estimated to be achieved from implementing each measure
  • the total energy savings estimated for each measure broken down by organisational purpose
  • estimation methods used to calculate energy savings
  • any context to proposed measures (where provided)

Updated Publication of Phase 3 Notification of Compliance Data

A link to data from Phase 3 NOCs was issued in the February 2025 Issue 34 ESOS newsletter. The Phase 3 Notification of Compliance Data Publication has now been updated to include all NOC data submitted up to 5 June 2025.

Publication Platform

A supplier appointed by DESNZ is conducting research into making published ESOS data more accessible to ESOS participants and members of the public through a bespoke publication platform.

Representatives from businesses that participate in ESOS are sought to participate in 1-hour long remote interviews which will ask them about their perceptions and experiences related to energy use reporting. The supplier is particularly interested in speaking with senior leaders (e.g. directors, senior managers), whether or not they engage with ESOS data.

The interviews will take place between 22nd July – 1st August. 4 slots per day will be available for volunteers to choose from via a link. Interviews will be recorded, with notes taken on the basis of informed consent and anonymised. If interested, please contact DESNZ for further details.

Q&A

What are the compliance rates for NOCs and action plans?

Over 80% of ESOS participants are now compliant with these requirements, with more organisations currently being brought into compliance.

What is happening to organisations that have not submitted a NOC or an action plan?

The legislation requires all organisations that qualify for ESOS to submit a NOC and an action plan, including where no measures are proposed to be implemented in the action plan. Organisations that have not addressed these requirements are being investigated by the compliance bodies (the Environment Agency in England and other regulators for the devolved regions and offshore waters) and enforcement action may be taken against them.

I have not submitted a NOC or action plan can I still do so?

Those organisations that have not addressed these requirements may be at risk of enforcement action and should contact the Environment Agency immediately for advice on what to do next.
